These Terms of Service ("Terms") govern your access to and use of CourtKeeper ("Service"), operated by FreshStarts.io ("we," "us," or "our"). By using the Service, you agree to these Terms.

Important Notice: CourtKeeper is a tool to assist with deadline tracking. It is not a substitute for professional legal judgment. You are solely responsible for verifying all deadlines and calendar entries.

1. Description of Service

CourtKeeper is an AI-powered deadline extraction and calendar management service designed for legal professionals. The Service:

Processes court documents submitted via email
Uses AI to extract dates and deadline information
Presents extracted deadlines for your review and approval
Syncs approved deadlines to your Google Calendar

2. Account Registration

To use the Service, you must:

Provide accurate and complete registration information
Be at least 18 years of age
Maintain the security of your account credentials
Promptly notify us of any unauthorized access to your account

You are responsible for all activity that occurs under your account.

3. Fees and Payment

3.1 Pricing

Setup Fee: $750 one-time (split as $375 at booking, $375 upon completion)
Monthly Subscription: $297 per month
Annual Subscription: $2,999 per year

3.2 Billing

Subscription fees are billed in advance on a monthly or annual basis
All fees are non-refundable except as provided in our money-back guarantee
We may change our pricing with 30 days notice

3.3 Money-Back Guarantee

We offer a 30-day money-back guarantee. If you are not satisfied with the Service within the first 30 days of your subscription, contact us for a full refund of subscription fees paid (setup fees are non-refundable after setup is complete).

4. Use of the Service

4.1 Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You will not:

Use the Service for any illegal purpose
Submit documents you do not have the right to process
Attempt to gain unauthorized access to our systems
Interfere with or disrupt the Service
Resell or redistribute the Service without authorization

4.2 Your Responsibilities

Critical: You are solely responsible for:

Reviewing all extracted deadlines for accuracy
Verifying deadlines against original court documents
Approving or rejecting deadlines before they sync to your calendar
Maintaining your own backup systems for deadline tracking

5. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

We do not warrant that:

The Service will be uninterrupted or error-free
AI extraction will be 100% accurate
The Service will meet all your requirements
Results obtained from the Service will be accurate or reliable

The AI technology used in our Service, while sophisticated, can make errors. You must verify all extracted information.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

Missed court deadlines
Malpractice claims
Loss of clients or business
Loss of data
Any damages arising from errors in deadline extraction

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

7. Indemnification

You agree to indemnify and hold harmless CourtKeeper, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:

Your use of the Service
Your violation of these Terms
Your violation of any rights of another party
Any claim that your use of the Service caused damage to a third party

8. Intellectual Property

The Service, including its design, features, and content, is owned by us and protected by intellectual property laws. You retain ownership of your documents and data.

You grant us a limited license to process your documents solely for providing the Service.

9. Termination

9.1 By You

You may cancel your subscription at any time through the billing portal or by contacting us. Cancellation takes effect at the end of your current billing period.

9.2 By Us

We may suspend or terminate your access to the Service if you:

Violate these Terms
Fail to pay fees when due
Engage in fraudulent or illegal activity

9.3 Effect of Termination

Upon termination:

Your access to the Service will cease
You may request export of your data within 30 days
We will delete your data in accordance with our Privacy Policy

10. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the modified Terms.

11. Governing Law

These Terms are governed by the laws of the State of Nebraska, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Sarpy County, Nebraska.

12. Dispute Resolution

Before filing any legal claim, you agree to attempt to resolve disputes informally by contacting us. If informal resolution fails, any dispute shall be resolved through binding arbitration, except that either party may seek injunctive relief in court.

13. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and CourtKeeper regarding the Service.
